General terms and conditions
Article 1 – Definitions
In these terms, the following definitions apply:
Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
Consumer: A natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Day: Calendar day.
Duration transaction: A distance contract concerning a series of products and/or services, the delivery and/or acceptance of which is spread over time.
Durable medium: Any means which allows the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: The ability of the consumer to cancel a distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
Distance contract: A contract concluded in the context of a system organized by the entrepreneur for the remote sale of products and/or services, where only one or more means of remote communication are used until the contract is concluded.
Means of remote communication: Means that can be used to conclude a contract without the consumer and entrepreneur being physically present together.
General Terms and Conditions: These General Terms and Conditions of the entrepreneur.
Article 2 – Right of Withdrawal
Consumers have the right to withdraw from the contract within 30 days without giving any reason. During this period, the consumer must handle the product and packaging carefully. Returned products must include all accessories and, where reasonably possible, be in the original condition and packaging.
Article 3 – Applicability
These terms apply to every offer and distance contract between the entrepreneur and the consumer. The text of the terms will be made available to the consumer prior to concluding the contract, either electronically or on paper.
Article 4 – The Offer
Offers may be limited in validity or conditional. All product images and specifications are indicative. Shipping costs, payment, delivery methods, and acceptance periods will be clearly stated.
Article 5 – The Contract
Contracts are concluded when the consumer accepts the offer and meets the conditions. Confirmation will be sent electronically if applicable.
Article 6 – Right of Withdrawal
Consumers may withdraw from purchases within 30 days. The cooling-off period starts the day after the product is received. Notification of withdrawal must be sent by email to support@nalu.fashion, and the product returned within 30 days.
Article 7 – Costs of Withdrawal
Return shipping costs are borne by the consumer. Refunds will be made within 30 days using the original payment method once the product is received.
Article 8 – Exclusion of Withdrawal
The right of withdrawal may not apply to personalized, perishable, sealed hygiene, or digital products after opening.
Article 9 – Pricing
Prices are fixed for the validity period in the offer. Price changes due to law or financial market fluctuations may occur.
Article 10 – Conformity and Warranty
Products must comply with the contract and legal requirements. Factory warranties apply, but misuse or modifications void coverage.
Article 11 – Delivery and Execution
Orders will be processed with due care and delivered within 30 days, unless otherwise agreed. Replacement products will be offered if items are unavailable.
Article 12 – Duration Transactions
Long-term agreements can be terminated with up to 1 month notice, unless otherwise agreed.
Article 13 – Payment
Payments are due within 7 business days unless otherwise agreed. Consumers must notify of any incorrect payment information immediately.
Article 14 – Complaints
Complaints must be submitted within 7 days of noticing defects. Responses will be provided within 14 days.
Article 15 – Disputes
All contracts are governed by New Zealand law.
